The Pearl Events Center Grand Forks

1. Assumption of Risk

I, the undersigned, acknowledge and understand that renting and using the venue “the Pearl Events Center” located at 920 North Third Street, Grand Forks North Dakota for the purpose of hosting a private event involves certain risks, including but not limited to personal injury, property damage, or loss, including theft. I voluntarily assume all such risks while using the venue, patio, and grounds.


2. Waiver and Release

I hereby waive, release, and discharge the venue owner/operator, its employees, agents, contractors, and affiliates from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or illness that may be sustained by myself, my guests, vendors, or any third party as a result of the rental and use of the

venue.


3. Indemnification

I agree to indemnify, defend, and hold harmless the venue owner/operator from and against any and all claims, liabilities, damages, costs, and expenses (including attorneys’ fees) arising from or related to:

- Any breach of this agreement

- Any acts or omissions by myself, my guests, or hired vendors

- Any damage to the property, fixtures, or equipment

- Any injury or death sustained by any party during the event


4. Compliance with Rules and Laws

I agree to comply with all rules, policies, and local/state/federal laws, including but not limited to:


- Alcohol regulations

- Noise ordinances

- Fire and safety codes

- Occupancy limits


I understand that failure to comply may result in immediate termination of the event without refund or compensation of any sorts.


5. Insurance Requirements

I understand that all professional vendors (e.g., caterers, bartenders) must provide proof of insurance with a minimum $1,000,000 liability coverage, naming the venue owner/operator as an additional insured party.


6. Damage & Cleaning Responsibility

I agree to complete the cleaning checklist provided by the venue. I am responsible for all damages caused by myself or my guests. A post-event inspection will determine if any part of the security deposit is withheld.


7. Acknowledgement

I have read and understood this Waiver of Liability and Indemnification Agreement. I fully understand its terms, and I sign it freely and voluntarily, intending to be legally bound. The venue reserves the right to **inspect and approve** vendor setups to ensure compliance with safety regulations. Open flames, fireworks, or any hazardous materials are prohibited unless approved in advance. Security personnel may be required for large events or those serving alcohol. A venue staff member or designated event coordinator must be available for **emergency contact** during events.


___ I agree to contact my caterer, bartender, decorator, security contractor, etc. for copies of their insurance certificates and email those to the Landlord (14) days prior to the event. Failure to provide the required insurance will result in cancellation or restriction of catering

services at the venue.
